Even in the best of circumstances, probate can take time to complete, which can make things difficult for a family trying to move past the loss of a loved one. We wanted to take a few moments to address some of the questions we commonly receive from our probate clients.

I Don’t Understand Why Probate Is Necessary. Can You Explain Why We Have To Do This?

Probate is really the opportunity to get an accounting of the estate. Assets are collected, debts are paid and the remainder of the property is passed to intended beneficiaries listed in estate planning documents or according to Colorado’s intestate succession laws, if no will is present.

This can be a relatively complicated process, especially if beneficiaries have concerns over the validity of the will. Disputes can arise which can make probate take even longer to complete. We can provide you with detailed information about your options should you need assistance with any aspect of probate.

Do All Assets Have To Go Through Probate?

No. There are things that can be done to help pass along assets outside of the probate process. This may include using trusts, payable on death accounts and other methods of transferring property.

It is a good idea to discuss these options when creating your estate plan. Your strategy should allow you to take full advantage of all of the opportunities for you to pass property outside of probate. If you do not have such a plan in place, it could potentially result in assets being subject to forfeiture in order to pay the debts of the estate.
